Are items presented by JPateArts original artwork?

All paintings and commissioned pieces are original works of art produced by Mr. Pate and JPateArts. JPateArts stationery has been reproduced from Mr. Pates original artwork. The form, shape and likeness of all Texas Longhorn Sculptures are reproduced from Mr. Pates original cast molds. The painted image on each Texas Longhorn Sculpture, as it is presented, is in itself an original work of art. Back to top.

Is artwork copyrighted by JPateArts?

All sculptures, paintings, stationery, commissioned pieces, images, et al., are copyrighted by JPateArts, LLC. and are the intellectual property of Mr. Johnny Pate. Back to top.

What are my rights as the buyer in regards to displaying or altering what I purchase?

In general terms, the buyer has purchased the right to display the original sculpture, artwork, etc., purchased from JPateArts in their personal domain or place of business. In the case of altering, artwork is the personal property of the buyer and can be treated as such. Although, that goes against the reasons for buying a work of art. It becomes a question of legality when the buyer uses the altered artwork for purposes other than personal display. Back to top.

Can I reproduce the artwork I purchase from JPateArts?

The buyer owns the artwork in physical form. However, Mr. Pate and JPateArts, LLC. owns the image itself. In the case of the Texas Longhorn Sculpture, the physical likeness of the sculpture is copyrighted by Mr. Pate and JPateArts, LLC. The buyer can not reproduce in any form, or for any reason, items purchased from JPateArts without express and written permission. Back to top.

Can I negotiate the right to reproduce an image?

JPateArts, LLC. and Mr.Pate reserve the right to negotiate with the buyer in terms of use of artwork purchased. For example, a buyer might want to reproduce a painting for use as advertising and negotiate terms for the purchase of its copyright. Back to top.

What forms of payment does JPateArts accept?

Items can be purchased from JPateArts from our website with Visa/MasterCard, money order, cashier's check, or personal check. Visa/MasterCard transactions are processed through a secure server contracted by JPateArts.com. Items purchased with a personal check will be held approximately ten (10) business days or until check clears. Back to top.

Is sales tax included?

Texas residents will be charged 8.5% sales tax and is not included in the purchase price. Back to top.

Does JPateArts offer shipping and shipping insurance?

Shipping and shipping insurance is not included in the purchase price. Shipping insurance is not required but highly recommended for purchases. JPateArts is not responsible for items damaged in shipping. Back to top.

Does JPateArts accept returns/refunds for purchased artwork?

Returns are accepted for thirty (30) days from purchase date. Buyer is responsible for return shipping and insurance costs. Shipping insurance is required for all returns. JPateArts will accept any return of an item only in its original and undamaged condition. A refund check in the amount of the original purchase price, sales tax included, will be sent to the original buyer. Back to top.
